The general terms and conditions of sale described below detail the rights and obligations of Maison de Garniac and its customer in connection with the sale of goods offered for sale on the website www.garniac.fr.

Any service rendered by Maison de Garniac therefore implies the buyer’s unreserved acceptance of these terms and conditions of sale.

The products

Our products are available while stocks last.

• Sale of fresh truffles: the net weight is checked before each shipment, but the buyer should be aware that, as a fresh mushroom, truffles may lose weight during transit. In addition, quantities available are limited and may require additional delivery time.

Offer validity period

The prices shown are those in force on the day the order is placed. They are denominated in euros and calculated inclusive of VAT, excluding processing and shipping costs. In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of Maison de Garniac. They are your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country.

Maison de Garniac reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered, subject to their availability.

How to order

All orders, whatever their origin, are payable in euros.

Products remain the property of Maison de Garniac until full payment has been received. Orders are processed from Monday to Friday, subject to product availability.

A detailed invoice will be enclosed with each order.

Maison de Garniac reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Validation of your order

Any order placed on the www.garniac.fr website implies acceptance of these General Terms and Conditions of Sale. Any confirmation of an order implies full acceptance of these terms and conditions, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of this. Confirmation of the order will constitute signature and acceptance of the operations carried out.

Terms of payment

Payment at time of order.

No discount will be granted for early payment.

Terms of payment

To pay for his order, the buyer has the following methods of payment: CB / Visa / Master Card

Payment for orders must be made :

• online by credit card via a secure “STRIPE” connection
• by cheque payable to “Maison de Garniac”.
• by bank transfer

Orders will be dispatched upon receipt of payment.

Late payment

In the event of total or partial non-payment for goods delivered, the buyer must pay Maison de Garniac a late payment penalty equal to three times the legal interest rate. The legal interest rate is that in force at the time. This penalty is calculated on the amount due, inclusive of tax, and runs from the due date of the price, without the need for prior formal notice.

In addition to late payment penalties, any sum, including the deposit, not paid by the due date will automatically give rise to the payment of a fixed penalty of 40 euros due for collection costs.

Deliveries and shipments

Deliveries

Products are delivered to the delivery address indicated during the ordering process. Any delay in delivery may not give rise to damages, withholding or cancellation of the order by the purchaser.

In the case of deliveries by a carrier, Maison de Garniac cannot be held responsible for late delivery due exclusively to the customer’s unavailability.

If the buyer is absent from the delivery address, the parcel is left at the nearest post office or parcel relay. The buyer then has 24 hours to collect it, in order to guarantee the freshness of the products. After 48 hours, the buyer takes responsibility for damaged goods. No claim will be taken into account.

It is understood that goods always travel at the consignee’s risk.

The delivery time is 8 working days (every day of the week, except Sundays and public holidays) after the online order.

Shipments

In mainland France :

No delivery on Sundays and public holidays. Shipping and handling costs are indicated when you place your order and in the “delivery” section. When necessary, packages are sent at controlled temperatures.

Abroad :

Contact us for a quotation. Shipping costs and delivery times. Delivery costs are calculated according to the total weight of your order. Delivery times depend on the destination and product availability.

The withdrawal period

In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty. Returns must be made in their original state and complete (packaging, accessories, etc.). In this case, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal. You are responsible for return shipping costs. If you exercise your right of withdrawal, Maison de Garniac will reimburse the sums paid within 14 days of being notified of your request, using the same means of payment you used to place the order.

Exceptions to the right of withdrawal

In accordance with the provisions of article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply:

– Fresh products likely to deteriorate or expire quickly.

– To the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

Availability

Our products are offered as long as they are visible on the www.garniac.fr website and while stocks last. For products not in stock, our offers are subject to restocking.

If a product is unavailable after you have placed your order, we will inform you by email of the delivery time.

Liability

The products offered comply with current French legislation. Maison de Garniac shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.

Maison de Garniac cannot be held responsible for any damage resulting from misuse of the product purchased.

Lastly, Maison de Garniac cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.

Maison de Garniac cannot be held responsible for the non-fulfillment of the contract in case of stock shortage or unavailability of the product due to a case of force majeure, disruption or total or partial strike in particular of the postal services and means of transport and/or communications.

Intellectual property

All elements of the www.garniac.fr website are and remain the exclusive intellectual property of Maison de Garniac. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual or audio.

Applicable law / Disputes

These conditions of sale are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the Tribunal de Commerce de Nîmes, which shall have sole competence, irrespective of the place of dispatch.

Personal data

Maison de Garniac reserves the right to collect nominative information and personal data concerning you. This information is required to process your order and to improve the services and information we send you.

It may also be transmitted to companies that contribute to this relationship, such as those in charge of executing services and orders for their management, execution, processing and payment.

This information and data is also stored for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to personal information and data concerning you, directly on the website.

Proof archiving

Maison de Garniac will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.

The computerized registers of Maison de Garniac will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
